TRAINING TERMS & CONDITIONS

Terms

  1. All terms will be subject to English Law.

  2. Us, we, our, are terms that C&D Access Ltd will be known as herein.

  3. They, you, candidate, student, are terms referred to the course and/or exam attendees.

  4. Whilst every effort will be made to keep to the advertised course content, C&D Access Ltd. Reserves the right to change course content as it deems necessary.

Acceptance of terms

  1. By booking your training with C&D Access Ltd. you are fully accepting the terms, conditions and disclaimers contained in this notice.

Bookings, Payments and Refunds

  1. We will only guarantee a booking once full payment or a purchase order number has been provided.

  2. C&D Access cannot accept Cash Payments.

  3. If you are making a company booking, then you must first be an approved company and must have been vetted by our Accounts Department before we can accept your booking. Details of how to become an approved supply company can be sought at training@cdais.co.uk .

  4. All quotes are valid for 30 days from the date of the quote. Any available dates provided are not guaranteed until full payment or purchase order number has been received.

  5. All bookings must be paid in full at least 14 natural days prior to the course or examination delivery date.

  6. Certifications will be sent to you via email and/or post, payment must have been received in full prior to despatch.

  7. C&D Access Ltd. hold no responsibility for any certification/cards lost in the post where a proof of postage has been obtained.

  8. All certification/cards will be sent via Royal Mail standard post unless specifically requested to do otherwise, charges may apply for this service.

  9. Requests for copies of certification are subject to an administration charge.

  10. Payment Terms are strictly 30 days from the date of invoice and at least 14 days prior to the course or examination delivery date.

  11. Late or non-payment of an invoice may result in interest being applied in accordance with the “Late Payment of Commercial Debts (Interest) Act 1998”.

  12. Should you decide to change your course date before it commences a minimum of 14 days’ notice shall be given. C&D Access will only allow one (1) course date move.

  13. We will endeavour to provide alternative dates if a request to reschedule a confirmed course is received. We reserve the right to charge the following rates in the event of rescheduling a course not initiated by C&D Access:

    • 0-5 working days before the course delivery date, original course will be invoiced in full, rescheduled course will be invoiced at 50% including any certification fees

    • 6-10 working days before the course delivery date, original course will be invoiced in full, rescheduled course will be invoiced at 25% including any certification fees

    • 11 - 14 working days before the course delivery date, original course will be invoiced in full, rescheduled course will be invoiced at 10% including any certification fees

  14. Should you need to move your course a second time then the payment will be foregone, and you will have to re-secure a place with another payment in full to secure the course.

  15. Should you need to change the date of a PCN examination, you have 60 days to sit your initially scheduled examination. Administration fee of £35 + VAT will be charged for each change. 

  16. No refunds or alternative dates will be offered for non-attendance on any paid course. Exceptional circumstances may be considered entirely at the discretion of C&D Access Management.

  17. C&D Access reserve the right to cancel any course booked for health, safety, insufficient numbers, practical matters and unexpected events beyond our control. In such instances we will offer you an alternative date or if that is not satisfactory then any moneys received will be refunded in full.

  18. We reserve the right to charge the following rates in the event of a cancellation not initiated by C&D Access Ltd.:

    • 0-5 working days before the course delivery date, 100% of the cost

    • 6-10 working days before the course delivery date, 50% of the cost

    • 11 working days + before the course delivery date, 25% of the cost

  19. Candidate names may be changed at any time without incurring additional charges as long as candidate numbers stay the same.

  20. Candidates arriving late may not be admitted onto a training course if doing so impacts the progress of others, or when the awarding body specifies a set number of learning hours. We will try and be as flexible as possible however in the event of no admission through late arrival, the client will be liable for 100% of the cost of the course. No refund will be given.

  21. All payments must be made in the GBP currency.

Candidate information

  1. C&D Access will forward Joining Instructions to the students/candidates prior to the course and/or examination delivery date. It is the student/candidate responsibility to read through and ensure the pre-requisites are fulfilled. If you fail to produce the correct pre-requisite information we reserve the right to cancel you or their involvement in the course without liability. No refunds will be given in such circumstances.

  2. PPE requirements will be also stated in the Joining Instructions. The majority of PPE required on our courses is provided, however all students and candidates should arrive with appropriate PPE as required in the Joining Instructions. The responsibility for required PPE lies with the candidate and C&D Access accepts no responsibility for the failure of the candidate to wear the correct PPE when required.

  3. Please if you have any special condition that may affect your learning, let us know as soon as possible. Counselling and assessment special consideration are available for learners with special needs.

  4. For any practical training the candidates must be physically fit enough to complete the course. If you have any known medical conditions or doubts about your fitness then you must make the instructor aware of this immediately. On some practical training, we will require you to sign a medial self-assessment.

Training with C&D Access Ltd.

  1. All students/candidates will abide by all Health, Safety, Environmental and Fire practices in place at the course location. These practices will take preference over all other aspects of the course.

  2. All students/candidates will be expected to behave in a manner befitting to the course, which is to dress respectively and appropriately, behave so as not be a disruptive influence on other candidates, refrain from being under the influence of alcohol and/or drugs and not to act in a criminal manner. Failure to do so will result in the candidate being ejected from the course, and reported to the police if necessary. No refunds will be given in this event.

  3. We reserve the right to eject any candidate flouting these rules and any neglectful damage to property.

  4. We will act to recover damages incurred by the candidate or candidate’s employer for any neglectful damage to property or serious disruption to the course caused by a candidate.

  5. We reserve the right to refuse students entry to a course if any fees are outstanding.

  6. We reserve the right to eject any candidate who, through lack of basic knowledge/competence if it’s deemed to be holding up the rest of the class.

  7. Any special requirements of a candidate should be specified on the Booking Form. We reserve the right to cancel the candidate’s entry to a course if this information has not been provided to us prior to the course delivery date, where it will negatively impact the smooth running of the course.

  8. Any information supplied to us on the Booking Form will be treated in confidence and in accordance to our Data Protection Policy.

  9. All bookings will be subject to candidates and their employers accepting these terms and conditions which are available upon request.

 

Liability

  1. C&D Access Ltd. will not be liable if we cannot provide the services to you because of an event beyond our reasonable control. Such events include, but are not limited to, fire, flood, storm, strikes or other industrial action, failure of telecommunications services, war, riot, or any actions of any government or public body, failure or insolvency of the training centre. If we are prevented from providing services by such an event we will take all reasonable steps to try and reinstate the provision of the services to you as soon as reasonably practicable.

  2. In no event will we be liable for any loss of profit, loss of earnings, loss of anticipated savings, loss of revenue or loss of goodwill that you may suffer in any event covered above.

  3. In no event will we be liable to you for any indirect or consequential loss that you may suffer.
